FORM Agency (“we”, “us”, “our”) respects your privacy. This policy explains how we collect, use, disclose and protect your personal information in Australia in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1) What we collect

We collect the following types of information:

  • Identity & contact: name, role, business name, email, phone, location.

  • Business & brand: website/Instagram links, brand assets you share (e.g., Drive/Dropbox), revenue band.

  • Competition entries: your answers to entry questions and any optional video links.

  • Marketing & comms: email preferences, enquiry history.

  • Usage data: pages viewed, device/browser data, IP address, referral source, via cookies and similar tech.

  • Payment/admin (if you buy a service): billing details, invoices, project records. Payment card data is handled by our payment processor and not stored by us.

If you provide others’ personal information, you must have their consent.

2) How we collect it

  • Directly from you (forms, email, meetings, DMs, competition entries).

  • Automatically via our website using cookies, pixels and analytics tools.

  • From third parties where permitted (e.g., scheduling tools, ad platforms, payment processors).

3) Why we collect it (uses)

We use your information to:

  • Administer competitions and promotions, including assessing entries, contacting winners, showcasing results and producing case studies (with consents).

  • Provide and improve services, including proposals, project delivery, support and quality assurance.

  • Operate our website and marketing, including analytics, audience measurement, A/B tests, and retargeting.

  • Communicate, including replying to enquiries and sending updates you’ve opted into (you can opt out anytime).

  • Comply with law, manage risk, prevent fraud, and enforce our terms.

4) Lawful basis

Under Australian law, our basis includes your consent, performance of a contract, and our legitimate interests in running and improving our business. Where we rely on consent (e.g., marketing emails), you can withdraw it at any time.

  • Competition consent: you can choose what you submit; required fields are marked.

  • Case study/publicity: we will only publish identifiable materials with the consents described in our competition T&Cs.

11) Children

Our services and competitions are intended for adults (18+). We do not knowingly collect personal information from children.

12) Links to other sites

Our site may link to third-party websites. We’re not responsible for their privacy practices. Review their policies.

13) Complaints

If you have concerns about how we’ve handled your personal information, email hello@formagency.au and include “Privacy complaint” in the subject. We’ll respond within a reasonable timeframe.
